The government says it's going to put a tax lien on me. What does that mean?

Answer:

When you owe the IRS back taxes, interest, and various penalties, the IRS can issue a tax lien against you.  Such a lien essentially means that the IRS has the right to seize your property or your wages in order to pay back what you owe in such taxes and fees.  While appealing a federal tax lien is possible, it is best to resolve the issue as quickly as you can to avoid the lien in the first place.

The IRS can issue a tax lien for various unpaid taxes, including:

  • Income taxes
  • Gift taxes
  • Estate taxes

By law, the federal government must give you a final notice before issuing a tax lien against you, known as written notice and demand.  You typically have 10 days to address your tax problem after receiving a notice and demand.  If you fail to address the problem in that period of time, the tax lien goes into effect immediately.   

If you are subject to an IRS tax lien, or you have received a notice and demand, you must act quickly to save your assets and to get on track with the IRS.  Consult with an attorney, file all relevant back taxes, determine precisely what you owe, and make a payment arrangement with the IRS immediately.  This tax problem will not go away on its own, so do not try to ignore it.
